• Accuracy: All prices are listed in US dollars and are subject to change without notice. Pelagia is not responsible for typographical or pricing errors, and reserves the right to correct any such errors, including on orders already placed.
• Availability: Acquisitions are subject to availability. If an item becomes unavailable after an order is placed, we will contact you directly to arrange a refund or alternative.
• Order Acceptance: Receipt of an order confirmation does not guarantee acceptance of your order. Pelagia reserves the right to limit or cancel quantities purchased, at our sole discretion.
• Taxes: Applicable sales tax is calculated and added at checkout based on your shipping destination.

Pelagia garments are manufactured and tested to meet applicable US federal safety requirements for children's products under the Consumer Product Safety Improvement Act (CPSIA), including limits on lead and phthalate content, and are covered by a Children's Product Certificate (CPC) issued following third-party laboratory testing.

Garment fiber content, country of origin, manufacturer identity, and care instructions are disclosed on the permanent label sewn into each garment, as required under the FTC's Textile Fiber Products Identification Act and Care Labeling Rule.

Pelagia garments are made with Supima® cotton, used under license and in accordance with Supima's trademark guidelines. Supima® is a registered trademark of Supima, used to identify premium US-grown Pima cotton fiber content; it is not Pelagia's own trademark.

Where referenced, GOTS (Global Organic Textile Standard) and Oeko-Tex Standard 100 Class I certifications reflect current, active certifications held for our garments. Pelagia maintains documentation supporting every certification claim made on this site, consistent with FTC guidance on substantiating environmental and safety marketing claims.

The Pelagia name, logo, Guardian of Beginnings mascot, aesthetic, website content, and all photographic and video content are the exclusive property of Pelagia Baby Corp. Any unauthorized reproduction, distribution, or use of these assets is strictly prohibited and protected under applicable copyright and trademark law.

You agree to use this site only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, this site by any third party.

Pelagia provides its products and website "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, except as required by applicable consumer protection law.

To the fullest extent permitted by law, Pelagia shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our products or website. Our total liability in connection with any order shall not exceed the amount paid for that specific order.

Nothing in these Terms limits any warranty, right, or remedy that cannot be excluded under applicable consumer protection or product liability law, including claims arising from personal injury caused by a defective product.

You agree to indemnify and hold Pelagia harmless from any claim arising from your misuse of the site or violation of these Terms.

These Terms and any disputes arising from your relationship with Pelagia shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
